What You Can Do If You Do Not Agree with the Plan Dismissal
If the plan dismisses a level 1 appeal request, the enrollee or other party has the right to request that C2C review the plan’s dismissal. The enrollee also has the right to request that the plan vacate the dismissal.
How to Request Review of Plan Dismissal
A Plan Dismissal Letter includes full instructions about how to request that C2C review a plan’s dismissal. Include a copy of the plan’s “Notice of Dismissal of Appeal Request” along with any supporting information in your request. C2C must receive your request within 60 calendar days of the day you received your Plan Dismissal Letter. Your receipt of this letter is presumed to be five (5) days after the date stated above.

What to Expect:
C2C will review your request. If C2C determines that the plan’s dismissal of the level 1 appeal request was in error, C2C vacates the dismissal and remands the case to the plan. If C2C agrees with the plan’s dismissal of the level 1 appeal request (i.e., upholds the plan's dismissal), then C2C will issue an unfavorable decision. C2C’s decision regarding a plan’s dismissal of a level 1 appeal request is binding and not subject to further review.
Your Rights During the Second Level of Appeal
You have the right to send us information about your case. You can have someone—such as a friend, family member, doctor or lawyer—help you write this information. Please include your name and appeal number.
During a second level of appeal, you also have the following rights:
- You have the right to ask C2C to send letters in a language you understand.
- You have the right to a copy of your case file.
- You have the right to receive a written appeal decision from C2C.
